1. Who we are
Groundwork ("Groundwork", "we", "us") is operated by [OPERATOR LEGAL NAME], [COUNTRY]. You can reach us at groundworkbids@gmail.com. By subscribing to or using the service, you ("you", "your company") agree to these terms. If you are accepting on behalf of a company, you confirm you are allowed to do so.
2. The service
Groundwork provides a weekly email and report (the "Report") and access to a private subscriber portal (together, the "Report") summarizing commercial development projects, based on public records such as city planning agendas, staff reports, project narratives, plans and building-permit data, together with our own analysis (for example fit scores and estimated bid windows). The service is intended for businesses, not consumers. We may change the report's format, coverage area or delivery day over time.
3. Free trial, billing and cancellation
- Free trial. New subscribers receive the Report and portal access free for their first 14 days (two weekly issues). No payment details are required, and nothing is charged automatically when the trial ends.
- Plans. After the free trial, the subscription costs US$49 per month (monthly plan) or US$490 per year (yearly plan), unless we agree otherwise in writing.
- Founding price. Subscribers who join during the founding period keep their price for as long as their subscription stays active. For everyone else we'll give at least 30 days' notice of any price change.
- Payment and renewal. Nothing is charged when the free trial ends unless you choose a plan. Paid plans are billed in advance through our payment processor, Stripe, by card or US bank account, and renew automatically each month (monthly plan) or year (yearly plan) until you cancel. Invoices and receipts are available in the portal under Settings → Billing. If a payment fails, it is retried; the Report and portal access may be paused if a payment is more than 14 days late, and come back once it is paid.
- Cancel anytime. Cancel in the portal under Settings → Billing, reply "cancel" to any Report, or email us. On the monthly plan, cancellation takes effect at the end of the month you've paid for, with no partial-month refunds. On the yearly plan, we refund the full months you haven't started.
- Taxes. Prices exclude any taxes that may apply to you.
4. Data sources, accuracy and no guarantee
The Report is compiled from public records published by government bodies, including the City of Mesa and Maricopa County, and from other publicly available information. Groundwork is not affiliated with, endorsed by or acting for any government body, developer, contractor or other party named in a Report.
Public records can be incomplete, out of date or wrong, and projects change or get cancelled. Fit scores, bid windows and "call first" suggestions are our opinions and estimates. We quote our sources so you can check them, and you should confirm all information with the relevant parties before relying on it, including before pricing or bidding on any work. We do not guarantee that the service will lead to any bid, contract or revenue.
The Report is business research. It is not legal, financial, engineering or professional advice.
5. How you may use the Report
- You may use the Report inside your own company, for your own business development.
- You may not resell, republish, share publicly, or give the Report or its contents to people outside your company, or use it to build a competing product, without our written permission.
- You may not use automated tools to copy the website or the service.
- Portal access is for the people at your company whose email addresses you gave us. Don't share sign-in codes.
6. Contacting people named in a Report
Reports can include business contact details that appear in public filings, such as the developer, architect or engineer on a project. If you contact them, you are responsible for doing so professionally and lawfully, including under laws that apply to marketing emails, calls and text messages (for example, in the US, CAN-SPAM and the Telephone Consumer Protection Act). Do not use Report contacts for spam, harassment or any unlawful purpose. If anyone asks you to stop contacting them, stop.
7. Intellectual property
The underlying public records belong to their publishers. The selection, arrangement, summaries, scores, analysis and design of the Report and this website are ours. Your subscription gives you a limited, non-exclusive, non-transferable right to use the Report as described in section 5.
8. Disclaimer of warranties
To the fullest extent permitted by law, the service and all Reports are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, Groundwork will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost bids, lost contracts or lost data, arising from or related to the service. Our total liability for any claim related to the service is limited to the amount you paid us in the three (3) months before the claim arose. Some jurisdictions do not allow these limits, in which case they apply only as far as the law allows.
10. Indemnity
You agree to defend and indemnify Groundwork against claims arising from your misuse of the Report, including how you contact people named in it or any breach of these terms.
11. Suspension and termination
We may suspend or end a subscription if these terms are breached, if payment is not made, or if we stop offering the service in your area. If we end the service for reasons other than your breach, we will refund any amount you prepaid for Reports not delivered.
12. Changes to these terms
We may update these terms. If a change is significant, we'll tell subscribers by email at least 14 days before it takes effect. Continuing to use the service after that means you accept the updated terms.
13. Governing law and disputes
These terms are governed by the laws of [GOVERNING JURISDICTION], without regard to conflict-of-law rules. Before starting any formal dispute, both parties agree to try to resolve it informally by email for at least 30 days.
14. General
If any part of these terms is found unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver of it. These terms are the entire agreement between you and Groundwork about the service. You may not transfer your subscription without our consent.
